This Dump Trailer Rental Agreement ("Agreement") is entered into between:
Florida Dump and Go will deliver the trailer to the location above and pick it up at the end of the rental period. The Renter is not permitted to tow, drive, or transport the trailer with any vehicle unless the Renter holds a valid automobile insurance policy that covers loss of the trailer during the rental period and has provided proof of such coverage to the Owner. Full payment is due at time of booking or delivery. Accepted payment methods include credit/debit card, cash, and electronic payment.
A $200.00 refundable security deposit is required for all rentals and will be collected at or before pickup.
The deposit may be applied, in whole or in part, to cover any of the following:
Any remaining deposit balance will be refunded within 5–7 business days following the return and inspection of the trailer. Refunds will be issued via the original payment method unless otherwise agreed in writing.
The trailer may only be used for lawful purposes, including but not limited to:
The following uses are strictly prohibited:
Violation of any prohibited use may result in immediate termination of this Agreement, forfeiture of the security deposit, and the Renter's full liability for any resulting damages or legal consequences.

The Renter is solely responsible for all damage caused by overloading or improper loading. The Owner assumes no liability for incidents resulting from the Renter's failure to comply with this section.
Florida Dump and Go will deliver the trailer to the Renter's specified location and pick it up at the end of the rental period. The Renter acknowledges and agrees that:
Any attempt by the Renter to move, tow, or transport the trailer shall be considered a material breach of this Agreement and the Renter shall be fully liable for any and all damage, injury, or loss resulting from such action.

The Renter will be held financially responsible for:
The Renter is fully responsible for any damage, loss, or theft of the trailer or its components that occurs during the rental period, regardless of fault or cause.
The Renter agrees to:
Costs for damage, loss, or theft may be deducted from the security deposit, and if the costs exceed the deposit amount, the Renter will be billed for the remaining balance and agrees to pay promptly.
The Renter acknowledges that since the trailer is delivered and picked up by the Owner, the Renter is not required to maintain automobile insurance for towing. However, the Renter is responsible for any damage to the trailer or third-party property that occurs while the trailer is in the Renter's possession at the delivery location.
DISCLAIMER OF WARRANTIES:
THE TRAILER IS RENTED "AS IS." THE OWNER MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE OR MERCHANTABILITY. THE RENTER ASSUMES ALL RISKS ASSOCIATED WITH THE USE OF THE TRAILER.
INDEMNIFICATION:
The Renter agrees to defend, indemnify, and hold harmless Florida Dump and Go, its owners, employees, and agents from and against any and all claims, demands, suits, losses, damages, injuries, liabilities, costs, and expenses (including reasonable attorney's fees) arising out of or related to: (a) the Renter's use of the trailer; (b) any breach of this Agreement by the Renter; or (c) any negligent or wrongful act or omission by the Renter or any person using the trailer with the Renter's permission.
EQUIPMENT TOWING & DRIVING (MINI SKID STEER):
Where the rented item is a mini skid steer or similar equipment (rather than a stationary dump trailer), the Renter is permitted to tow, drive, or transport the equipment only if the Renter holds a valid automobile insurance policy that covers loss of the rented equipment during the rental period. The Renter must provide proof of such coverage upon request. Any towing, driving, or transportation of the equipment without qualifying insurance coverage is a material breach of this Agreement. The Renter assumes all risk of loss and agrees to indemnify and hold harmless Florida Dump and Go from any claims, damage, injury, or liability arising out of the Renter's towing, driving, or transporting of the equipment. This clause supersedes the towing prohibition set forth in Sections 4, 5, 6, and 15 solely with respect to equipment rentals; the prohibition remains in full force for dump trailer rentals.
The trailer must be returned by the agreed return date and time stated in Section 2.
If you need to extend your rental period, please contact us at least 2 hours before the scheduled return time to request an extension. Extensions are subject to availability and additional fees.

The Renter agrees to be responsible for all costs associated with recovery of the trailer, including towing fees, storage fees, attorney's fees, court costs, and any other expenses incurred by the Owner.
This Agreement shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles.
Any disputes arising out of or relating to this Agreement shall be resolved exclusively in the state or federal courts located in Pinellas County, Florida, and the parties hereby consent to the personal jurisdiction of such courts.
WAIVER OF JURY TRIAL: To the extent permitted by Florida law, both parties waive the right to a jury trial in any action arising from or related to this Agreement.
This Agreement may be executed by electronic signature. Both parties agree that electronic signatures are valid, binding, and legally enforceable under the Florida Uniform Electronic Transaction Act (F.S. Chapter 668, Part II) and the federal Electronic Signatures in Global and National Commerce Act (E-SIGN Act, 15 U.S.C. § 7001 et seq.).
By electronically signing this Agreement, the Renter acknowledges that their electronic signature is the legal equivalent of their handwritten signature and that they intend to be bound by the terms of this Agreement.
An electronic record of this Agreement, including the Renter's electronic signature, date, and IP address, will be maintained by the Owner and constitutes the binding original agreement.
By signing this Agreement, the Renter acknowledges and agrees that:
